CWIA's Terms and Conditions for Service
CWIA's goal is to provide as unrestricted and satisfying an Internet
experience as possible for our customers. These common rules are designed to satisfy what
the law demands, and to protect CWIA and it's customers. These terms and conditions are
similar to what you would find at any quality ISP, and are the general guidelines the
Internet community tends to deem as good 'netiquette'. These Terms and Conditions apply
to all CWIA customers, from personal dialup accounts to T3 HICAP clients.
- CWIA reserves the right to modify these terms and conditions without prior notice at
any time. Please bookmark this page and visit this location at least once a month.
- Enforcement of Terms and Conditions Depending upon the circumstances of any
violation of our Terms and Conditions (including any actions that cause damage,
downtime, excessive load, or harm to people or systems) we may issue a warning, suspend
your service, or terminate your account - without notice or refund. (And if appropriate,
we bill/collect our fee of $150 per-hour to repair malicious damage caused by
mail-bombing, hacking or attempting to damage our system, or other networks via our
system.)
- Illegal actions
We are required by law to report any criminal activity that we become aware of. Be aware
that if it comes to our attention that you are using our system to commit illegal acts
(e.g., storing or transporting commercial software via our system illegally) we must
immediately suspend/terminate your service.
- Harassment and privacy
Do not snoop or disturb other users' files or directories. Do not harass any of our staff
or other customers. You may not harass or make threats against another person via email or
news or any other electronic media/service we make available. Nor may you impersonate
another person. We support your right to free speech, but can't support you if you abuse
others.
Making public or providing any of our system files to other persons on the Internet is
forbidden.
- Spamming
Spamming is not tolerated at CWIA. Sending unsolicited email - whether "mass" or
targeted is not allowed. Also, you may
not use CWIA as a 'drop off' address for replies to spam mail or spam posts sent from
other networks. Subscriber accounts allow a maximum of 25 recipients per email message per
day . If you run a mail server (e.g. an SMTP mail server), you must ensure that this server can not be used to relay mail between one third party and another. All mail handled by your server should either originate at your network or terminate at your network. SUBSCRIBER SHALL PAY A CHARGE OF
$5.00 PER EXTRA EMAIL WITH A MINIMUM CHARGE OF $500 PER DAY. IF WE RECEIVE
COMPLAINTS OF UNSOLICITED SPAMMING, YOUR SERVICE WILL BE IMMEDIATELY TERMINATED AND NO
REFUNDS WILL BE GIVEN AND YOU WILL BE SUBJECT TO ADDITIONAL CIVIL ACTION IF YOUR ACTIONS
HAVE CAUSED INCREASED EXPENSES OR LOSS OF SUBSCRIBERS.
- External spamming of our subscribers
Our subscriber's are considered to be entitled to freedom from harassment. Therefore
anyone doing unsolicited spamming of our customers shall be subject to a charge of $5.00
per unsolicited email to our customers.
- Denial of service attacks
You may not mount an attack against our system or any other. This includes mail bombing,
"hacking" or attempting to gain root access, tsunami or flood bots or annoyance
utilities like "nuke" or "flash", employing packet sniffers, flood
pings, etc.
- Telneting in to Shell
You may telnet in a reasonable number of concurrent sessions. Note however that
simultaneous telnet sessions originating from multiple disjoint networks will be assumed
to indicate that the user's password has been compromised or shared. We reserve the right
to restrict access until we can determine whether or not the account has been breached.
- Technical support
We at CWIA are proud of our technical support staff. To maintain the high quality of
technical support our customers expect, we must limit the availability of telephone tech
support to the primary account holder. We cannot provide tech support for other persons
whom you may authorize to use your account, such as your wife, brother, business partners,
etc..
Similarly, we must limit tech support to issues related to connectivity only. We cannot
teach you how to design your web pages, how to write perl scripts, how to compile code,
etc.. We can only offer such help on a consultancy basis, or we may refer you to other
specialists. The support limit is 2 calls/month or 10 minutes which is least. You will be billed for additional support at a rate of $1.00/minute.
- Payment and billing
Monthly charges accrue from the time you sign up until the time you formally cancel with
written notice via email or postal mail to CWIA. All charges are for a 1 month
period and will not be prorated for a portion of a month. Much like having to pay for a
rented movie even if you don't watch it, you must pay for your Internet access ability
even if you don't log in and use it. All credit card billing dates are the beginning of
the week (Sunday or Monday) for that week (ie. if the Monday is the 1st, the credit card
billing will be for those accounts with anniversary dates the 1st thru the 7th). All
cancellations must be received prior to the billing date. Usage based accounts are prepaid service. The initial prepayment for service (like a calling card purchase) will be $20.00 for 1cent accounts. When balance
drops below $10.00, you will receive a charge to bring balance back to $20.00 prepayment. There are no refunds for balances on useage based service. If you are
not going to use your account for an extended period (1 month,minimum), you must notify
CWIA in advance to avoid paying for that interval. Please see Deactivate to deactivate or Disconnect
to discontinue service. No telephone disconnects or deactivates are accepted. We
must have an email or mail request. If you want receipt in case of dispute, please put your new email address in the comments box. Without receipt of cancellation, it is impossible for us to honor any dispute about whether service was really requested to be cancelled. For more details about our dialup or

All startup fees and equipment sales must be paid for in advance, before equipment is
shipped or circuits are activated. All activation fees are nonrefundable. There are no refunds on quarterly payments. Refunds on 6 or 12 month accounts will be the amount remaining after the number of months used with a 3 months minimum charge times the current posted monthly rate or the number of minutes used times .01 whichever is greater is subtracted.
- Extra charges and fees
CWIA reserves the right to charge (and collect) for additional expenses incurred. Some
services are optional and provided at a nominal charge. Listed below are rates for these
services: (Add travel time to all hourly rates where appropriate. All hourly rates 1/2
hour minimum.)
Changes to existing Domain Name information - $ 10
Adding an email address - $5 one time fee and $1/mo.
Changing CWIA types of service - $ 5
Changing CWIA login name - $ 5
Reactivating an account - $ 5
Per-hour fee for technician-level support (e.g., billing research, web consulting,
training, debugging scripts/code/configurations, etc.) - $ 85
Per-hour fee for engineering-level support (e.g., router configuration, telco problem
resolution, Sr. Sysadmin issues, research on collection issues, harassment, banking,
investment, marketing,
design, or legal matters) - $ 150
Late fee - $ 10
Credit card dispute fee - $ 25
Payment by Check - $1.00/mo. if you are paying monthly
Returned check fee - $ 15
Declined credit card fee: $ 5
Overusage fee (charged after 150 hours/mo): $ .30 per hour.
Re-connection fee (re-activate payment restricted account) - $5
Per-hour fee to research/prepare/collect/process defaulted debts - $ 85
Use of free web page for commercial purpose - $9.95/mo.
Excessive and unnecessary billing changes - $ 15 per occurrence.
Domain name billing issues:
CWIA charges $25 for moving, registering, or deleting a domain name. (Our Business and
commercial account customers get one free domain action per account. CWIA does not charge
fees on behalf of the Internic - Internic charges (and domain ownership issues) are always
the responsibility of the customer.All domains hosted by CWIA or using our DNS servers,
are kept at CWIA until the customer has paid all past debts to CWIA. We will not process
any request to move any domain for any customer having a past-due amount owed to CWIA; and
we reserve the right to wait for the check/payment to clear the bank before releasing the
domain. Similarly, we cannot move domains to CWIA from other ISPs in cases where unpaid
debts to the former ISP are a problem.
Dialup usage
CWIA's dialup accounts are flat-rate for normal and reasonable usage. While we allow
family/business users to share one account (using one modem per account), the total
connect time must be less than 150 hours in any given month (equivalent to 5 hours of
connect time each and every day of the month.). AOL flat rate is 75 hours in a
month.
We enforce these limits to ensure that all of our customers will have equal access
to the connection for which they are paying. The vast majority of our customers will never reach
these limits. Customers exceeding these limits will be billed at the next higher rate tier
(personal account billed at extra usage rates listed above, business account billed at
dedicated account rate).
With the exception of dedicated dialup accounts, extended interval sessions that are
either idle for periods of over 10 minutes, or running only automated functions such as
email checks, unattended chats, pings, etc., may be terminated. Customers who continue to run unattended accounts will have their services discontinued without refund. DO NOT RUN UNATTENDED PROGRAMS. Our telecos refresh lines that have been connected over 8 hours. When using email, connect and download email. Then disconnect and read and respond to mail offline. Then reconnect and send email. Email boxes that get full and have not been checked for over two months will be deleted. A new email box with a new email address can be setup by emailing accounting.
Local number
Make sure that CWIA's dialup number is local to you! CWIA can not, and will not be held
responsible for phone charges, whether due to error, a telco error, or yours. Always check
with your telephone company to insure CWIA's number is local to you. CWIA will not
reimburse for telephone company expenses under any circumstance.
Concurrent dialups
Only one simultaneous dial-in per account. This means that you may not use more than one
of CWIA's modems at the same time. If you are found logged in more than once over a modem
connection, we will assume that your password has been compromised and will immediately
suspend your account. You may be subject to billing for the additional usage if it is
found that you were using multiple dialins. There are some circumstances when we may
permit multiple dial-ins for business accounts.
Disk allotments
Customers with flat rate service are allocated maximum 5Mb bytes of storage for free web
pages (personal non commercial pages only. Suitable viewing for all ages) and five
megabytes for email spool space. Customers using free web pages for commercial purposes
will be billed $9.95/mo. Commercial purposes include any form of selling including posting
pictures of items you are selling thru other sites (ie. ebay auction items). Maximum
download from web pages is limited to 100Mb per month. If you need more, please see rates
for purchasing other service. Users that wish web space should email cwiaacct@cwia.com to
request space. A folder will be set up into which the user may ftp their web pages. Paid
personal accounts start from five megabytes of disk space for their home directory/web
space, paid business accounts from ten megabytes for business space. Additional rates are
listed in rates for other services. Paid sites have access to CGI scripts. Email stored
for periods longer than 60 days shall be subject to removal. If email boxes become clogged, CWIA will remove clogged email by clearing the email box. All email will be lost and is not recoverable.
Emulators, IRCs, MUDs, and other Servers
IRCbots may not be run on CWIA, except with the prior explicit permission of the
administrators. Bots found running will be terminated, files associated with them may be
deleted.
The use of SLIP or PPP emulators on the UNIX shell is not allowed.
Bandwidth/CPU usage
You may make whatever material you like available for FTP or WWW as long as it is legal
and it does not generate traffic in excess of 200 Megs per day (Personal accounts) or 400
Megs per day (Business accounts). For this reason, we strongly recommend that our
customers avoid storing any adult-oriented materials here. If your Internet site suddenly
sucks giant amounts of bandwidth, we retain the right to restrict access to it for such
interval as we deem necessary to maintain availability of bandwidth for all users.
Similarly, your actions/processes may not consume an unreasonable amount of system
resources/CPU cycles.
Network availability
CWIA's uptime record is of a high degree, and when a part of our system (or yours) is
down, it is usually because of a telco's error or failed equipment. CWIA is not
responsible or liable for loss of revenue, inconvenience, or any kind of liability for
downtime. CWIA disclaims any and all responsibility for any consequential damages related
to such loss or damage. We can not refund for temporary service outages, no matter what
the cause. We also make no guarantees of network speed since we have no control of a major
portion of the network.
Backup of data
Not a rule, but another topic involving common sense - Backups.
CWIA performs regular, scheduled backups, but nothing in this world is failsafe. If you
have something critical to your career or hobby, it makes sense to keep a copy of it
locally on your own computer, in addition to ours. Our backups are designed for recovery
from serious system failures - not for recovery of files accidentally or intentionally
deleted by users. We may be able to restore files a user has deleted, but there are
substantial charges associated with doing so. CWIA disclaims any and all responsibility
for the loss of, or damage to, any customer data stored on our system, or for any
consequential damages related to such loss or damage.
Newsgroup service
Newsgroup service is not included in our service.
Limitation of Service
We reserve the right to refuse service to anyone.
Common sense is the best policy, try not to do things that could harm or annoy CWIA,
our customers, or the Internet.
